TERMS AND CONDITIONS OF BOOKING AND TRAVEL

1. Booking and Payment

  • A deposit 30% is required to confirm a booking.
  • The balance is payable before departure, commonly 60 days prior to travel.
  • Bookings made close to the departure date may require full payment upfront.

2. Cancellation and Refunds

  • Cancellations must be submitted in writing.
  • Cancellation charges generally increase as the departure date approaches.
  • No refunds are usually provided for unused services or early termination of a safari.

3. Price Changes

  • Safari operators may reserve the right to adjust prices due to:
    • Government tax changes
    • National park fee increases
    • Fuel surcharges
    • Supplier rate changes beyond their control.

4. Travel Documents

  • Clients are responsible for obtaining valid passports, visas, permits, and any required travel documents.
  • The company is typically not liable if a traveler is denied entry because of incomplete documentation.

5. Health Requirements

  • Travelers are responsible for ensuring they meet vaccination and health requirements.
  • Any medical conditions that could affect travel should be disclosed before booking.

6. Travel Insurance

  • Comprehensive travel and medical insurance is strongly recommended and often required.
  • The company generally accepts no liability for losses that could have been covered by insurance.

7. Liability and Risk

  • Participation in safaris is generally at the traveler's own risk.
  • The company acts as an agent for hotels, airlines, lodges, and other suppliers and is not responsible for their actions or failures.
  • Liability for injury, loss, delay, or damage is usually limited to the extent permitted by law.

8. Force Majeure

  • The company is not liable for disruptions caused by events outside its control, such as:
    • Natural disasters
    • Pandemics
    • Political unrest
    • Strikes
    • Acts of terrorism.

9. Complaints and Dispute Resolution

  • Complaints should be submitted in writing within a specified period.
  • Disputes are generally governed by the laws of Kenya and resolved through Kenyan courts.
